Terms of Service for CiK Land Service

Last Updated: [9/14/2026]

1. Introduction
These Terms of Service ("Terms") govern all junk removal, land clearing, brush hogging, stump grinding, and hauling services provided by CiK Land Service ("CiK Land Service," "we," "us," or "our"). By requesting a quote, scheduling service, or allowing work to begin, you ("you" or "Customer") agree to be bound by these Terms.

2. Services
2.1 Scope of Work
The specific services to be performed, including any limitations or exclusions, will be described in your written quote, estimate, or work order (collectively, the "Service Agreement"). Only the services listed in the Service Agreement are included in the price.

2.2 Changes to Scope
If conditions on-site differ from what was originally described or expected (for example, additional debris, hidden obstacles, or access issues), we may adjust the price and/or schedule. We will communicate any changes and obtain your approval before proceeding.

3. Scheduling, Access, and Site Conditions
3.1 Scheduling
Service dates and times are estimates and may be adjusted due to weather, equipment issues, or other factors beyond our control. We will make reasonable efforts to notify you of any changes.

3.2 Access
You agree to provide safe and reasonable access to the property, including gates, driveways, and work areas, on the scheduled service date. If we cannot access the site or conditions are unsafe, we may reschedule and/or charge a trip or cancellation fee.

3.3 Site Conditions
You are responsible for informing us of any known hazards, underground utilities, septic systems, drainage lines, or other buried structures. We are not responsible for damage to items that were not properly marked or disclosed.

4. Estimates, Pricing, and Payment
4.1 Estimates
All estimates are based on the information you provide and, when necessary, an on-site assessment. Estimates are typically valid for a limited time, as stated on the estimate or quote.

4.2 Pricing Adjustments
If the actual conditions or requested work differ from what was originally estimated, we may revise the price. We will discuss any changes with you before continuing work.

4.3 Deposits
For larger projects, we may require a deposit before scheduling or beginning work. The deposit amount and terms will be stated in your Service Agreement.

4.4 Payment Terms
Unless otherwise stated in writing, payment is due upon completion of the job. We accept the payment methods listed on our website, invoice, or Service Agreement. Late or unpaid balances may be subject to late fees, interest, and/or collection costs as permitted by law.

5. Materials, Debris, and Disposal
5.1 Junk and Debris Removal
We will remove and dispose of junk, debris, and vegetation as described in the Service Agreement. Items not listed may be subject to additional charges.

5.2 Prohibited or Restricted Items
Certain items, including but not limited to hazardous materials, chemicals, paints, oils, fuels, asbestos, medical waste, and other regulated materials, may not be accepted. You are responsible for informing us of any such materials in advance. If prohibited items are discovered, we may refuse to remove them and/or charge additional handling fees.

5.3 Ownership of Removed Materials
Once items are loaded into our equipment or vehicles, they become our property, and we may dispose of or recycle them at our discretion, unless otherwise agreed in writing.

6. Property Conditions and Potential Damage
6.1 Reasonable Care
We will use reasonable care while performing services. However, land clearing, heavy equipment operation, and junk removal carry inherent risks.

6.2 Surfaces and Access Routes
You understand that equipment and vehicles may cause ruts, compaction, or other marks on lawns, driveways, or access routes, especially in wet or soft conditions. We are not responsible for normal wear and tear or minor damage reasonably associated with the work.

6.3 Hidden or Underground Items
We are not responsible for damage to underground utilities, irrigation systems, septic systems, drainage lines, cables, or other hidden obstacles that were not properly marked or disclosed.

7. Weather, Delays, and Force Majeure
We may pause, reschedule, or modify services if weather or site conditions make the job unsafe or impractical. We are not liable for delays or failure to perform due to causes beyond our reasonable control, including severe weather, accidents, equipment failure, labor issues, or other force majeure events.

8. Customer Responsibilities
You agree to:
- Obtain any required permissions, permits, or approvals from property owners, HOAs, or local authorities.
- Clearly mark known underground utilities, septic systems, and other buried structures.
- Remove or secure personal property that could be damaged during the work.
- Keep children, pets, and bystanders away from the work area at all times.

9. Warranties and Guarantees
9.1 No Guarantee of Future Conditions
We do not guarantee future conditions of the property, including regrowth of vegetation, soil stability, erosion, or drainage performance.

9.2 Limited Service Guarantees
Any specific guarantees or warranties for workmanship will be described in writing in your Service Agreement or invoice. If you believe there is an issue with our work, you must notify us within a reasonable time so we can review and, if appropriate, address the concern.

10. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of or related to our services is limited to the amount you paid for the specific job giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or loss of use.

11. Insurance
We maintain insurance coverage customary for our type of work. Proof of insurance may be provided upon request.

12. Cancellations and Rescheduling
If you need to cancel or reschedule, please contact us as soon as possible. We reserve the right to charge a fee for same-day cancellations, no-shows, or repeated rescheduling.

13. Governing Law
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict of law principles. Any disputes will be resolved in the appropriate state or federal courts located in West Virginia.

14. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to These Terms
We may update these Terms from time to time. The most current version will be posted on our website. Your continued use of our services after changes are posted constitutes your acceptance of the updated Terms.

16. Acceptance
By requesting a quote, scheduling service, signing a Service Agreement, or allowing work to begin, you acknowledge that you have read, understood, and agree to these Terms of Service for CiK Land Service.
